The following is a list of frequently asked questions by students who have been referred to meet with the Judicial Officer. If you have additional questions, please feel free to email the Judicial Officer at dkmckittrick@dmacc.edu.

  1. Why does DMACC have a Student Code of Conduct?

Consistent with our educational mission, DMACC is committed to having a safe learning environment. Accordingly, all students are expected to conduct themselves in a manner as to show respect for properly constituted authority, exhibit and maintain integrity and honor in all matters related to the College and not interfere with or disrupt the orderly educational processes of the College. DMACC's Student Code of Conduct describes behaviors that are contrary to our expectations that could result in disciplinary actions.

  1. How can I learn more about DMACC's disciplinary process?

The best way to learn about DMACC's disciplinary process is to read and review the Student Conduct/Discipline Procedure which is found in the Student Handbook or on the Student Conduct website.

  1. If I have been asked to meet with a Dean/Provost or the Judicial Officer to discuss a student conduct incident, what will happen at this meeting?

If you are requested to have a disciplinary conference to discuss a student conduct incident, you should be prepared to share information that will help the Dean/Provost or Judicial Officer understand the incident from your perspective. The administrator will share information with you about DMACC's Student Code of Conduct and answer any questions you may have. Depending on the severity of the student conduct violation, you may find out that day if any sanctions will be implemented or you may receive a letter in the mail within 5 business days. If the administrator believes that suspension from the College may be warranted, you will be informed about the process of meeting with the College Judicial Hearing Board.

Please note that if you fail to attend a disciplinary conference or a hearing before the College Judicial Hearing Board, a decision about your responsibility or non-responsibility and a sanction may be implemented in your absence.

  1. What type of sanctions may I receive if I am determined to be responsible for violating the Student Code of Conduct?

A student who is found to have violated DMACC's Student Code of Conduct may be subject to the following sanctions: reprimand, restitution, conduct probation, re-enrollment requirements, educational sanctions, suspension or termination of the use of college property, resources or activities, suspension from the College or certain courses for a specified period or expulsion from the College.   1. Can I bring an attorney, a parent, or another advisor to a disciplinary conference or hearing?

You are welcome to bring up to two Loading...​​​ with you to a disciplinary conference or College Judicial Hearing Board. Advisors may help you prepare for the hearing and can help advise you on during the hearing, but are not permitted to actively participate in the hearing by asking questions of witnesses or addressing the hearing board.

  1. Can DMACC charge me with violating the Student Code of Conduct if the incident occurred off-campus?

The Student Conduct, Discipline, and Appeals Procedure applies to conduct that occurs on DMACC College Property, at DMACC sponsored activities (including study abroad programs), at clinical sites, attendance centers, or any College facility, and off-campus conduct that adversely affects the DMACC community and/or the pursuit of its educational mission. Students who violate municipal, county, state or federal laws may be sanctioned by DMACC if it is determined that the conduct poses a clear and distinct interest to the educational community. The Judicial Officer shall decide whether the student conduct policy shall be applied to conduct occurring off-campus, on a case-by-case basis.

  1. If I am being charged with a crime in court, isn't this double jeopardy?

The DMACC disciplinary process is a separate process from criminal court proceedings. If your conduct violates municipal, county, state or federal laws, as well as DMACC's Student Code of Conduct, you are responsible for responding to both the criminal justice system and DMACC's disciplinary process. Please note that DMACC uses a different standard of proof (preponderance of the evidence) than the criminal justice system (beyond a reasonable doubt). Even if you are found "not guilty" in a criminal court or it was determined that there was not enough evidence to hear your case in court, you may still be asked to have a hearing at DMACC to discuss your behavior.

  1. What can I do if I do not agree with the sanction imposed by a Dean/Provost, Judicial Officer or the College Judicial Hearing Board?

Students have the right to appeal the decision of a Provost/Dean, Judicial Officer, or the College Judicial Hearing Board. More information can be found in the Student Conduct/Discipline policy.

  1. Will my parents or a potential employer have access to my disciplinary records?

Disciplinary records are a confidential part of student's educational records and cannot be shared with any 3rd party (parents, spouses, employers) without a student's written permission. Additional information about DMACC's compliance with the Family Educational Rights & Privacy Act (FERPA) can be found in the Student Handbook.

  1. Will anything appear on my transcript due to this incident?

If the student is suspended or expelled from DMACC, a notation will be placed on the student's transcript for the entire term of the student's suspension indicating that the student is suspended due to disciplinary action.

  1. Why do I have a "student conduct" hold on my DMACC account?

If you fail to respond to a letter or phone call from a Provost/Dean or the Judicial Officer requesting to schedule a disciplinary conference, a "student conduct" hold may be placed on your account preventing you from registering from classes or obtaining a copy of your academic transcript.

  1. If I am suspended from DMACC, will I receive a refund from my classes or be permitted to withdraw from my classes?

DMACC's normal drop and refund dates are applicable. If the student is suspended from classes within the established drop period, then the student may choose to withdraw from his/her courses. The only exception would be if the student has been found responsible for Loading...​ and has been given the sanction of a failing grade for the course; the student is then not permitted to withdraw from that particular course.

  1. How long will my disciplinary records be maintained by the Judicial Officer?

Disciplinary records are considered educational records and are normally maintained by the Judicial Officer for a period of seven years unless the student is suspended or expelled from DMACC, then those records are maintained indefinitely.
